LEGAL AGREEMENT and TERMS OF USE

1. This Web Site (the “SHAR Foundation Site”) is operated and maintained by SHAR (Self Help Addiction Reorientation) Foundation, a Michigan non-profit corporation, and is offered to you expressly on the terms of this Agreement. By accessing this site, you are accepting and agreeing to be bound by each of these terms, which may be modified by SHAR Foundation at any time. Amended terms are effective upon being posted and you should, therefore, review these Terms of Use from time to time. Your access and use of the SHAR Foundation Site after the effective date of amended terms means that you have accepted the amended terms. This Agreement cannot be otherwise amended.

2. This Agreement shall be construed and governed by the laws of the State of Michigan, United States of America without regard to choice of law principles. You agree that the courts located in Washtenaw County, Michigan shall have exclusive jurisdiction and venue over any action brought to enforce the rights and obligations in or arising from this Agreement and each of the parties irrevocably submits to the jurisdiction of such courts.

3. The contents of the SHAR Foundation Site are meant to provide information that is accurate to the best of our knowledge. SHAR Foundation is not responsible for inaccuracies or other errors on this or any other site to which the SHAR Foundation Site is linked. By offering you links, SHAR Foundation is not endorsing any other sites and SHAR Foundation has no responsibility for the content of other sites. You assume the full risk and responsibility for the use of any information or documents obtained on or accessed through the SHAR Foundation Site.

4. THE INFORMATION ON THE SHAR FOUNDATION SITE, AND ANY SITE TO WHICH THIS SITE IS LINKED, IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. IT IS NOT THERAPY IN ANY FORM, NOR IS IT MEANT AS A SUBSTITUTE FOR THERAPY.

5. All content included on the SHAR Foundation Site, including the text, photographs, graphics, video and audio content, logos, trademarks or service marks, icons, screens and configurations, is the property of SHAR Foundation or its licensors and is protected by U.S. and international copyright and trademark laws, as a compilation or collective work and/or individually. All software used on the SHAR Foundation Site is the property of SHAR Foundation or its software suppliers and is also protected by U.S. and international copyright laws. SHAR Foundation grants you permission to reproduce documents (including graphics) available on the SHAR Foundation Site, provided that: (a) the SHAR Foundation copyright notice appears on all copies thereof; (b) such use is for informational and non-commercial or personal use only; (c) no modifications are made to such documents and (d) no graphics are used separately from the accompanying text. Any other use or misuse of the content of this web site is strictly prohibited.

ALL INFORMATION AND DOCUMENTS ON, OR ACCESSIBLE FROM THE SHAR FOUNDATION SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL SHAR FOUNDATION BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL, PUNITIVE OR OTHER DAMAGES OF ANY KIND WHATSOEVER RESULTING FROM ANY CAUSE WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, OR LOSS OF DATA, WHETHER IN ANY ACTION UNDER THE THEORIES OF CONTRACT, NEGLIGENCE OR STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SHAR FOUNDATION SITE OR ANY INFORMATION OR DOCUMENTS ON OR ACCESSED THROUGH THE SHAR FOUNDATION SITE.

7. In general, SHAR Foundation does not collect personal identifying information from visitors to the SHAR Foundation Site unless such information is provided by the individual. However, certain non-personal information is recorded by the standard operation of SHAR Foundation’s Internet servers, including the type of operating system and browser being used by the visitor. The information we collect allows us to make statistical analyses of the use of our site, to improve the content of our site, and to customize our site to better suit your needs. All information you provide in accessing and using the SHAR Foundation Site may be used by SHAR Foundation as described in our Notice of Privacy Practices, which is included as a part of this Agreement.

8. Children under 13 should not send any information about themselves to us, including information like your name, address or e-mail address. SHAR Foundation does not knowingly collect personally identifying information from children under the age of 13. In the event that we learn that we have collected such information from a child under 13 without parental consent, the information will be deleted from our database as soon as reasonably possible.

9. You agree to indemnify SHAR Foundation and its respective officers, directors, members, employees, agents representatives, parents, subsidiaries, affiliates, licensors and content providers for and from any loss by reason of, in any way relating to, or arising out of: (a) your use of this web site and any violation of any law, rule or regulation arising out of such use or (b) any violation of this Agreement.
